Session 1: Changing Landscape Related to PFAS, TSCA, and Product Liability

Per- and polyfluoroalkyl substances (PFAS) – also known as “Forever Chemicals” have dominated the environmental and chemical manufacturing attention.  This class of chemicals presents a continuing challenge for all industries due to the evolving and unique regulatory landscape.   This presentation, given by GSI’s expert in PFAS toxicology and regulations, will provide an overview of the regulatory, legal and corporate policy implications for U.S. industries that may use, or have, PFAS in their supply chain.  The presentation will differentiate between PFAS fact and fiction and will highlight why the scientific and regulatory communities have differing interpretations of the science related to these chemicals.  Current product compliance requirements and legal challenges will be presented, with recommendations for secondary manufacturers and distributors of products containing PFAS.

Dr. Janet Anderson is a Diplomate of the American Board of Toxicology and Principal Toxicologist with over 15 years of experience providing toxicology, risk assessment, and risk management strategies for emerging and unregulated contaminants to federal agencies, private industry, and municipal clients. Dr. Anderson specializes in the translation of human health toxicology data into state and federal regulatory policy decisions related to environmental risk, remediation, and public health. She conducts site-specific risk assessments, including for CERCLA sites and environmental justice settings, and provides product stewardship risk evaluations. She has broad experience assessing the potential toxic characteristics of chemicals to support scientifically sound decision-making and has extensive experience developing strategies to track, communicate, and mitigate human health risks and address potential liability associated with emerging chemicals such as per- and polyfluoroalkyl substances (PFAS).

Angela Lambert has over fifteen years of experience in product safety, warnings, and liability. In her role at Clarion Safety, she collaborates with manufacturers – as well as industry partners and advocates – on labels, signs and markings that can help reduce risk and protect people. That includes having a keen understanding of visual safety communication standards, as well as safety label content/design, color systems, and print production. From a standards perspective, Ms. Lambert is actively involved at the leadership level in the ANSI and ISO standards for product safety. She is chair of the ANSI Z535.1 subcommittee, leading the standard that focuses on colors used in visual safety communication. She is also a delegate representative to the ANSI Z535 committee, to the ISO/TC 145 SC2 WG 1 committee (responsible for the library of ISO 7010 registered symbols and the ISO 3864 set of standards), and to ISO/TC 283 (responsible for the ISO 45001 standard). Additionally, she is the liaison for ISO/TC 145 to ISO/TC 283, acting as a bridge between the international safety label/sign standards and workplace health/safety standards. Ms. Lambert is also an expert speaker on product safety and visual safety communication at universities and associations across the country.

He has published several articles and has presented numerous seminars in these areas. Mr. Neuens has tried numerous cases, including 35 jury trials, in both state and federal courts throughout the country. 

Judge Nicholas J. McNamara

Judge McNamara is a trial court judge for Dane County Circuit Court and has twice served as Presiding Judge of their Criminal Division. Since 2009 he has presided as judge for more than 200 jury trials, most of which involved criminal matters at all levels of seriousness. He also is an Adjunct Professor with the UW Law School, teaching Evidence since 2020, and Trial Advocacy courses from 1999 to 2008. Before taking the bench he was a trial attorney and shareholder with the law firm of Habush, Habush & Rottier, S.C. for 16 years. His practice specialized in plaintiffs’ personal injury cases with a primary focus on auto, general negligence, and care facility liability cases, along with additional litigation work in product liability and medical malpractice cases. He was the sole attorney for 55 jury trials, obtaining three verdicts in excess of $1 million, including the largest personal injury verdict in Wisconsin in 2007: Schaitel v. Sentry Ins. Co. et al, Monroe County case 04-CV-256. He earned certification as a Civil Trial Specialist by the National Board of Trial Advocacy in 2000. He graduated with a J.D. from the University of Wisconsin Law School in 1993, earned a B.A. with Honors from the University of Iowa in 1987, and was awarded a Fulbright scholarship to study philosophy in Germany in 1987-88.

She has more than 25 years of strong industry experience covering food and consumer products, most recently as Global Operations Corporate Compliance Manager for Wolverine Worldwide, and at Cabela’s Incorporated as Senior Manager, Integrity & Compliance. Previously Melanie was Risk Manager, Business Continuity / Auditing and Supply Quality Specialist / Auditor at Diageo North America. She is a Certified HACCP Auditor (CHA/FSQA), Certified Manager of Quality / Organizational Excellence (CMQ/OE), and a Certified Quality Improvement Associate (CQIA) fro Times New Roman m the American Society for Quality. Melanie is an FDA FSMA PCQI for Human and Animal Food, IA VA, and FSVP Lead Instructor. 

Melanie was responsible for risk management and factory audit programs in the Americas portfolio of facilities (factory, DC, offices, distilleries) for a $17B world-leading manufacturer of premium beverages. She supervised internal and third-party response teams in responding to customer, in-market, and manufacturing quality concerns, and led product recall planning and corporate response. She has developed and delivered training programs for instructors, employees, and managers on safety, security, risk assessment, Code of Conduct, and other topics. Additional experience included corporate quality systems implementation projects across North America, planning and execution of gap analysis audits for wholly owned, third-party, and supplier manufacturing facilities, and distribution centers in the U.S. and internationally. 

Melanie has directed strategy and operations for teams globally, responsible for benchmarking level assessments to gain insight, inform, and align resources for corporate compliance strategy. She engaged business functions to ensure global compliance operations were effective in meeting customer compliance (Disney, Target, etc.), licensee, and wholesale business compliance needs related to manufacturing code/social compliance and consumer product safety for a $3B multinational leather, footwear, and apparel company. She led an initiative to renovate the global supplier due diligence audit program for a $3.7B multinational retail and finance company to ensure compliance throughout the supply chain. She developed and coached an audit team in executing factory audits and strategy for improvement, identifying risks and proposing improvements in Europe, Asia, and the Americas.

Tony is the recently retired Director of R&D Data Analytics at Abbott Laboratories, where he oversaw a broad spectrum of analytics responsibilities, ranging from statistics, reliability, and quality engineering to data management, advanced analytics, and business decision support. In his role at Abbott, Tony’s organization supported the development of diagnostic products currently contributing over $4 billion in annual worldwide revenue. With nearly 40 years of industry experience, he has served in leadership roles in both the automotive supply and medical diagnostics sectors, where he also championed Lean and Six Sigma methodologies in operations and product development as a Master Black Belt. In his new entrepreneurial venture, Tony is the owner of Convergent Analytics, a consulting firm. Here, his focus is on utilizing generative AI and data analytics to pioneer innovations in learning and development for technical organizations. This endeavor aims to equip the next generation of engineers, scientists, and analysts with the tools and insights needed to solve the complex challenges that industries face today and tomorrow.
