Introduction
Presentation 1: What is Product Safety and Why Does it Matter?
Justina Sanchez
Quality Engineer III, EHSQ
Product safety testing is the process of testing, inspecting, and certifying products to achieve compliance with consumer product safety standards. Certification of the product demonstrates that applicable requirements have been met by the certifying body and this give the manufacture the approval they need to sell to market.
Products that fail to meet applicable requirements can create substantial risks to both consumers and businesses. Consumers may be exposed to unreasonable hazards or dangers, and in turn, businesses could be subject to penalties and lawsuits. A rigorous testing program performed by an accredited product safety testing lab can therefore help mitigate these risks.
Presentation 2: From Data to Innovation: How Monitoring Product Performance Drives Better Design & Safety
Ryan Bigot
VP, Product Safety & Post-Sales Surveillance and VP, Off-Road Design Analysis & Testing
Polaris Inc.
Ryan Bigot of Polaris will discuss how monitoring feedback of product field performance, through AI analysis of warranty claims, product testing, interaction with the marketplace, field investigations and social media monitoring, play a critical role in improving product safety and product design.
Presentation 3: On-Product Warnings: ANSI Z535.4 and ISO 3864-2
Angela Lambert
Director of Inside Sales and Standards Compliance
Chairperson, ANSI Z535.1 Subcommittee
Clarion Safety Systems
“Failure to warn” and “inadequate warnings” continue to top today’s product liability allegations. Angela Lambert will provide an overview of the ANSI Z535.4 and ISO 3864-2 standards and how they can be used as the foundation for effective labels and instructions. Participants will gain an understanding of current considerations and implications for product safety labels and for risk management including the latest label format options, recent related standards updates such as the new ANSI Z535.7 standard, and emerging trends and issues.
Presentation 4: How to Protect Corporate Reputation Around Product Recalls
Eric Andrus
Executive Vice President, KARV Global
This presentation will cover the development of an effective communications strategy for a product recall situation – for both a voluntary and a unilateral recall scenario. It will address lessons learned about the most effective communications tactics companies can implement on their own throughout the recall to help position them to thrive in the aftermath. The presentation will include discussion of the strategic approaches to messaging, approval mandates imposed by regulators across traditional and social media, and communications considerations for each key external and internal audience a company should seek to inform about the recall and the remedy. Best practices for working with outside communications/PR professionals will also be offered.
Presentation 5: Product Safety Program Audits – An Often-Missed Opportunity
Don Mays
Product Safety Insights LLC
President, Society of Product Safety Professionals
Chairman, ASTM F15 Committee on Consumer Products
While financial audits are commonplace among major companies, product safety program audits are not. By benchmarking current practices, policies, and procedures against leading industry practices, audits can identify hidden gaps that present material weaknesses and expose companies to preventable risks. This session will explore how safety program audits can lead to a better culture of safety by developing critical thinking from end to end of a product’s lifecycle.
Presentation 6: Product Sourcing & Contracting: Reducing International Product Liability Risks
Dan Harris - Partner
Harris Sliwoski
This presentation by Dan Harris covers proven methods to reduce product liability risks when working with manufacturers outside the United States. Dan will reveal proven methods for vetting suppliers, build strong relationships, and structure contracts to reduce product liability risks. Key topics include quality control provisions, insurance requirements, and subcontracting risks. He will also demystify the complexities of international contract enforcement and provide practical steps to protect businesses from legal and financial risks when manufacturing overseas.
Presentation 7: Chemical Compliance and Risk in Products: U.S. Developments and Enforcement Trends
William L. Troutman, Esq.
Norton Rose Fullbright
Chemical compliance and risk issues in the United States seem to be more prominent than ever, with states, private plaintiffs, and NGOs targeting chemicals in products and viewing them as fertile ground for enforcement and disputes. This session will provide an overview of key chemical compliance and risk areas for products, with a focus on California’s Proposition 65 and the growing number of state laws prohibiting or restricting PFAS in products, followed by an update on federal, state, and private enforcement.
Presentation 8: Engineering Ethics and Design for Product Safety
Kenneth L. d’Entremont, Ph.D., P.E.
University of Utah
Department of Mechanical Engineering
Ergonomics & Safety (E&S) Program
Systems, Industrial, and Management Engineering Program (SIME)
Designing consumer products is difficult, especially since there are few—if any—hard-and-fast rules for “safe enough.” Dr. Ken d’Entremont will speak about the role of applied engineering ethics in product-design decision making. In addition, he will present a couple of simple conceptual product-design tools to better understand safety and safeguards.
Presentation 9: Essential Product Liability Insights for Integrating Lithium-Ion Batteries into Your Product
Chris Couteller, CSP
Chubb Insurance Company
Vice President, Executive Products Liability Specialist
Risk Engineering Services
Lithium-Ion batteries have become ubiquitous in our society, as they have become incorporated into so many products we use on a daily basis. Transitioning to this new form of portable power is not without risks. Lithium-ion batteries can be very powerful and add convenience, however, can also experience thermal runaways that can cause substantial property damage and bodily injury. The session is intended to provide guidance when considering transitioning from the traditional portable power such as Sealed lead acid, Ni-Cad or Alkaline batteries to Lithium-ion batteries.
Presentation 10: Effectively Evaluating and Addressing Case Risk in Product Liability Cases
Morgan A. Adams, MS
Senior Consultant & Director of Online Research
Stitch Risk Assessment, LLC
This presentation aims to challenge traditional thinking when it comes to assessing risk in product liability lawsuits by providing participants with a deeper understanding of how jurors approach these cases. It will explore key psychological and behavioral factors that influence jurors’ decision making. Additionally, participants will learn about practical risk assessment tools, crafting more compelling arguments, and ultimately enhancing their approach to defending or prosecuting product liability claims.
Presentation 11: Courtroom strategies for addressing the distrust and resentment of "big companies" that contributes to nuclear verdicts
Steve Quattlebaum
John E. Tull III
Quattlebaum, Tull & Grooms, PLLC
Jurors often have a severe distrust of the business world. The slightest deviation from the truth, whether it is mere “spin”, “stretching”, or just a “different perspective”, can turn a jury into an adversary like the slipping of a switch. There is widespread skepticism and distrust of established institutions such as government, business, religion, and medical care. Additionally, there appears to be a shift where personal feelings are often prioritized over objective truth. Organizations thus face significant challenges in litigation. Prominent defense trial lawyers Steve Quattlebaum and John Tull discuss the world of excessive verdicts, overcoming resentment of big companies, and how to humanize your company in this environment.
Presentation 12: Contractual Indemnity Agreements: Drafter Beware
Tomislav Z. Kuzmanovic
Hinshaw & Culbertson, LLP
Partner in Charge
Indemnity agreements aren’t just boilerplate legalese in a document. They are a vital tool which can protect from or deflect risks, damages or liabilities between contracting parties. This presentation will explore what an indemnity agreement is and how it may impact your business.
Presentation 13: Mock Deposition Exercise
Steve Quattlebaum
John Tull
Robert Zimmerman
Presentation 14: The Important Role of Plaintiffs' Counsel and Product Safety
Robert W. Zimmerman, Esq.
Samuel A. Haaz, Esq.
Saltz Mongeluzzi &Bendesky
Robert Zimmerman and Samual Haaz will share their insights on the role of a plaintiff’s attorney when a product causes harm. Having secured many multi-million-dollar verdicts and settlements, Mr. Zimmerman and Haaz will address some of their experiences as plaintiffs’ counsel to show companies need to put safety in the forefront for product design and warnings.
Presentation 15: The Current View from The Bench
Judge Kristine G. Baker
Chief United States District Judge
